All content, materials, features, and functionality available through our services, including but not limited to text, graphics, logos, images, video recordings, audio content, software, and data compilations, are owned by Eson Kardul or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our services for personal, non-commercial educational purposes.

5.3 Restrictions

7.2 Refund Policy

Refunds may be issued at our sole discretion within 14 days of purchase if you have not accessed substantial portions of the course content or webinar materials. Requests for refunds must be submitted to help@esonkardul.com with a detailed explanation.

7.3 Cancellation by Us

We reserve the right to suspend or terminate your access to our services at any time for violation of these Terms, non-payment, or for any other reason at our sole discretion. In such cases, fees may not be refunded.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT OUR SERVICES OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESON KARDUL, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF:

Your access to or use of or inability to access or use our services
Any conduct or content of any third party on our services
Any content obtained from our services
Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR ONE HUNDRED DOLLARS, WHICHEVER IS GREATER.

13. Termination

13.1 Termination by You

13.2 Termination by Us

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our services will immediately cease, and we may delete your account and content.

13.3 Effect of Termination

Upon termination of your account, all provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.

14. Dispute Resolution

14.1 Informal Resolution

If you have any dispute with us, you agree to first contact us at help@esonkardul.com and attempt to resolve the dispute informally. We will make good faith efforts to resolve disputes amicably.

14.2 Arbitration Agreement

Any dispute arising out of or relating to these Terms or our services that cannot be resolved informally shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

14.3 Class Action Waiver

You and Eson Kardul agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on our services, constitute the entire agreement between you and Eson Kardul regarding our services.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid or unenforceable provision will be deemed modified to the minimum extent necessary to make it valid and enforceable.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Eson Kardul.

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
